Associate Justice Caguioa hindi na in-charge sa poll election protest ni Marcos vs Robredo

Kinumpirma ni retired Senior Associate Justice Antonio Carpio na hindi na si Associate Justice Benjamin Caguioa ang member-in-charge sa poll protest case na isinampa ni dating senador Bongbong Marcos laban kay Vice President Leni Robredo.

Ito ay dahil tumutol si Caguioa sa mayorya ng Supreme Court En Banc kaugnay sa resulta ng recount sa tatlong pilot provinces na pinili ni Marcos sa recount.

Dahil dito, iniutos umano ng korte na muling i-raffle ang kaso para sa bagong member-in-charge.

“Justice Caguioa is no longer the member in charge because he was in the minority, he dissented. So I think the En Banc will raffle the case… I understand, there was an instruction to reraffle,” ayon kay Carpio.

Si Carpio ay kasama rin sa nag-dissent sa pasya ng mayorya dahil naniniwala itong dapat nang mabasura agad ang poll protest ni Marcos matapos siyang mabigo na makakuha ng substantial recovery o ng sapat na kalamangan kay Robredo sa isinagawang recount sa tatlong pinili niyang pilot provinces — ang Camarines Sur, Negros Oriental at Iloilo.

Samantala, ang naging ruling ng Presidential Electoral Tribunal sa petisyon ay bigyan ng pagkakataon ang magkabilang partido na masuri ang resulta ng revision at sila ay magsumite ng komento.

“We dissented because we wanted the protest to be dismissed right away because there was no substantial recovery but the majority said, we will not rule on that yet. We will wait for the comment so we still don’t know what would be the final ruling,” aniya.

“I think the court will make a ruling because the court requires the party to comment on the preliminary appreciation and to comment on the motion of protestant Marcos to include the three ARMM provinces. We just have to wait for the comment of the parties,” sabi pa ni Carpio.
