COA pinayagan nang makuha ang mga datos ng PhilHealth

Pinayagan na ng National Privacy Commission (NPC) ang Commission on Audit (COA) na pag-aralan ang mga datos ng Philippine Health Insurance Corp. (PhilHealth) na nasa ilalim ng imbestigasyom dahil sa korapsyon.

Sa inilabas na Advisory Opinion No. 2020-016 ng NPC, nakalagay na ang Data Privacy Act (DPA) ay hindi naman sinasarahan ang gawain ng mga pampublikong opisyal.

“DPA is not a restriction on COA’s gaining access to the personal information of data subjects collection by PhilHealth,” saad ni NPC Commissioner Raymund E. Liboro.

Ito ay kasunod ng umanoy personal data breach sakaling payagan ang COA na makuha ang personal na impormasyon ng mga opisyal ng PhilHealth NPC.

“It falls on COA and its sound judgment in determining what methods to use in the collection or gathering of personal data to perform its auditing function,” saad pa ni Liboro.

Sa pagpoproseso ng COA sa personal na datos, kailangan ng COA na siguruhing ang “personal data collected and processed shall be adequate, relevant, suitable, necessary and not excessive in relation to its declared and specified purpose, and that personal data shall be processed only if the purpose of the processing could not reasonably be fulfilled by other means,” ayon pa kay Liboro.
